Xborder Parcels — Sender Liability & Conditions of Carriage
1. Contents Declaration & Owner Responsibility
The sender is solely responsible for the accuracy of the contents declaration provided at the time of booking. By submitting this form, you confirm that the description of goods is truthful and complete. Xborder Parcels does not inspect parcels and accepts no liability for any misrepresentation of contents.
2. Prohibited & Illegal Goods
The sender warrants that the parcel does not contain any prohibited, restricted, or illegal items under the laws of South Africa or the destination country. If a parcel is confiscated, seized, or destroyed by customs authorities, border officials, or any law enforcement agency due to illegal or undeclared contents, Xborder Parcels bears no responsibility whatsoever. All fines, penalties, legal costs, and losses arising from such confiscation are the sole liability of the sender.
3. Insurance
Xborder Parcels does not provide insurance cover for any goods transported. The sender is solely responsible for arranging adequate insurance for the declared value of the parcel's contents. Xborder Parcels will not be held liable for loss, damage, or theft of goods during transit, whether in full or in part.
4. Loss & Damage
While Xborder Parcels takes reasonable care in handling all shipments, we do not accept liability for loss or damage caused by circumstances beyond our reasonable control, including but not limited to: road accidents, theft, natural disasters, civil unrest, border delays, or force majeure events.
5. Customs Duties & Border Clearance
The sender is responsible for ensuring that goods comply with import and export regulations of both South Africa and the destination country. Any customs duties, import taxes, or clearance fees levied by border authorities are the responsibility of the sender or recipient. Xborder Parcels will not advance or cover such costs on behalf of the sender.
6. Delays
Estimated transit times are provided in good faith and are not guaranteed. Xborder Parcels is not liable for delays caused by border congestion, customs inspections, public holidays, or any other circumstances outside our control.
7. Prohibited: Perishable Goods
Xborder Parcels does not accept perishable goods of any kind, including but not limited to food, beverages, fresh produce, meat, dairy, flowers, or any item that may deteriorate, spoil, or decay during transit. Any parcel found to contain perishable goods will be refused, returned, or disposed of at the sender's cost. No refund will be issued in such cases.
8. Right of Refusal
Xborder Parcels reserves the right to refuse, return, or dispose of any parcel that is found to contain prohibited items, is inadequately packaged, or poses a risk to staff, other parcels, or the public.
9. Governing Law
These conditions are governed by the laws of the Republic of South Africa. Any disputes arising from the carriage of goods by Xborder Parcels shall be subject to the jurisdiction of the South African courts.
